1. Website Use & Eligibility
1.1 This website is intended for individuals 18 years of age or older. By using this website, you confirm you meet this requirement and have legal capacity to enter a binding contract.
1.2 You may use this website for lawful purposes only. Unauthorized, fraudulent, or illegal activities are strictly prohibited and may result in civil or criminal liability.
1.3 By accessing or using ALFE Roofing's website (www.alferoofing.com) and related services, you agree to be bound by these Terms of Service. If you do not agree, please discontinue use immediately.
2. Services Provided
2.1 ALFE Roofing provides roofing-related services including roof inspections, repairs, replacements, gutter installation, and maintenance in Pennsylvania, New Jersey, and Delaware.
2.2 Our website provides information, educational resources, and promotional offers related to our roofing services. All estimates provided through our online tools are for informational purposes only and do not constitute a final contract price.
2.3 The information on our website does not constitute professional legal, structural engineering, or financial advice. We recommend consulting a licensed professional before making major roofing decisions.
3. Customer Responsibilities
3.1 Customers are responsible for providing accurate and complete information when requesting quotes or scheduling services. Inaccurate information may affect pricing and project timelines.
3.2 By submitting an inquiry or scheduling a service, you agree to allow ALFE Roofing to contact you via phone, email, or SMS for scheduling, follow-ups, or service-related communications. You may opt out at any time.
3.3 Customers must ensure safe access to their property for scheduled roofing services. Unsafe working conditions, obstructions, or inaccessible areas may result in rescheduling and/or additional charges.
3.4 Customers are responsible for obtaining any required homeowner association (HOA) approvals and ensuring compliance with local building codes prior to service commencement.
4. Payments, Deposits & Cancellations
4.1 Customers agree to pay for roofing services as outlined in their signed contract or invoice. Full payment is required upon completion unless a payment schedule is agreed to in writing.
4.2 Certain projects require a deposit before work begins. Deposits are non-refundable unless ALFE Roofing is unable to complete the service due to reasons within our control.
4.3 Cancellations require at least 48 hours' advance notice. Late cancellations or no-shows may result in a cancellation fee of up to $150 or 10% of the estimated project cost, whichever is greater.
4.4 Overdue balances exceeding 30 days from invoice date may be subject to a 1.5% monthly finance charge (18% APR) and/or referral to a collections agency.
4.5 In the event of a dispute regarding payment, the customer agrees to first contact ALFE Roofing to attempt good-faith resolution before initiating any legal action.
5. Warranties & Guarantees
5.1 ALFE Roofing provides limited warranties on roofing materials and workmanship as specified in your written contract. Warranty terms vary based on the scope of services, materials used, and applicable manufacturer warranties.
5.2 Workmanship warranties are void if:
- The roof has been modified, repaired, or altered by a third party without our written consent
- Damage results from severe weather events (hurricane, tornado, hail, ice dams, flooding)
- Damage results from neglected maintenance by the property owner
- Pre-existing structural deficiencies were not disclosed prior to service
5.3 Warranty claims must be submitted in writing to warranty@alferoofing.com within the warranty period. We will conduct an inspection within a reasonable time and determine the appropriate remedy at our sole discretion.
5.4 Manufacturer material warranties are governed by the respective manufacturer's warranty terms and may require registration by the homeowner.
6. Disclaimer
6.1 This website and all content herein are provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
6.2 Roofing projects are influenced by weather conditions, material availability, permit timelines, and property conditions. ALFE Roofing does not guarantee specific project timelines beyond what is outlined in your written contract.
6.3 Estimates provided through our online tools, including any instant quote systems, are for general informational purposes only and do not represent final contract pricing. Actual pricing is determined upon in-person inspection.
7. Limitation of Liability
7.1 Maximum Liability Cap. To the maximum extent permitted by applicable law, ALFE Roofing's total cumulative liability to you for any claims arising out of or related to these Terms, our website, or our services shall not exceed the greater of: (a) the total amount you paid to ALFE Roofing for the specific services giving rise to the claim in the twelve (12) months preceding the claim, or (b) $500.
7.2 Excluded Damages. In no event shall ALFE Roofing, its owners, officers, employees, subcontractors, or agents be liable for any:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, business, data, or goodwill
- Damage to property not directly caused by proven negligence during active service
- Third-party damage to the roof after service completion
- Loss of property value due to pre-existing structural issues not disclosed at time of service
- Delays caused by supply chain disruptions, material shortages, or adverse weather
- Acts of God, force majeure events, or circumstances beyond our reasonable control
7.3 Some states, including Pennsylvania, New Jersey, and Delaware, may not allow the exclusion or limitation of certain damages. If such laws apply, our liability is limited to the fullest extent permitted by law.
7.4 ALFE Roofing carries general liability insurance and workers' compensation insurance as required by law. Proof of insurance is available upon written request.
8. Indemnification
8.1 You agree to indemnify, defend, and hold harmless ALFE Roofing and its owners, officers, employees, contractors, agents, successors, and assigns from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of this website or our services
- Your breach of these Terms
- Your violation of any applicable law or regulation
- Inaccurate or misleading information you provided to ALFE Roofing
- Your failure to maintain safe access to the property during service
- Pre-existing property conditions that were not disclosed prior to service
8.2 This indemnification obligation survives termination or expiration of these Terms.
9. Data Security & Breach Notification
9.1 Security Standards. This website and our client-facing applications are built and maintained using industry-standard security practices, including but not limited to:
- HTTPS/TLS encryption for all data transmitted between your browser and our servers
- Secure credential storage using modern hashing algorithms (no plaintext passwords stored)
- Role-based access controls limiting data access to authorized personnel only
- Regular security assessments and code reviews
- Payment processing through PCI-DSS compliant third-party processors (we do not store raw credit card data)
9.2 No System is Infallible. Despite our implementation of industry-standard security measures, no information system is 100% secure. ALFE Roofing cannot guarantee absolute security of your personal information. You provide personal information at your own risk.
9.3 Breach Notification. In the event of a confirmed data breach that affects your personal information, ALFE Roofing will notify affected individuals in accordance with applicable breach notification laws:
- Pennsylvania: Breach of Personal Information Notification Act (73 P.S. §§ 2301–2329) — notification within a reasonable timeframe
- New Jersey: Identity Theft Prevention Act (N.J.S.A. 56:8-163) — notification in the most expedient time possible
- Delaware: Delaware Personal Data Privacy Act (6 Del. C. § 12B-102) — notification within 60 days of discovery
9.4 ALFE Roofing's aggregate liability for any data security incident is subject to the limitation of liability provisions in Section 7 above.
10. Mandatory Arbitration & Class Action Waiver Important
10.1 Binding Arbitration. PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms, our website, or our services — including any questions of validity, applicability, or breach — shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Construction Industry Arbitration Rules, rather than in a court of law.
10.2 Location. Arbitration shall be conducted in Philadelphia, Pennsylvania, unless both parties agree to a different location or to conduct the arbitration remotely.
10.3 Class Action Waiver. YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION, REPRESENTATIVE ACTION, OR COLLECTIVE PROCEEDING against ALFE Roofing. All claims must be brought in your individual capacity only.
10.4 Jury Trial Waiver. Both parties expressly waive their right to a trial by jury for any dispute covered by this arbitration agreement.
10.5 Small Claims Exception. Either party may bring an individual action in small claims court for disputes within that court's jurisdiction. As of the effective date, the small claims limit in Pennsylvania is $12,000.
10.6 Opt-Out. You have the right to opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to legal@alferoofing.com. Opting out will not affect any other provision of these Terms.
10.7 Survival. This arbitration agreement survives termination of the parties' relationship and these Terms.
11. Consumer Protection Rights (PA, NJ & DE)
11.1 These Terms do not waive any consumer protection rights guaranteed to you by mandatory applicable law. Your statutory rights under the following laws are preserved:
- Pennsylvania Unfair Trade Practices and Consumer Protection Law (UTPCPL), 73 P.S. §§ 201-1 et seq. — Prohibits unfair or deceptive trade practices. Violations may entitle consumers to actual damages, up to three times actual damages, and attorneys' fees.
- Pennsylvania Home Improvement Consumer Protection Act (HICPA), 73 P.S. § 517.1 et seq. — Governs home improvement contracts over $500. Requires written contracts, protects against fraudulent or deceptive acts.
- New Jersey Consumer Fraud Act (N.J.S.A. 56:8-1 et seq.) — Prohibits unconscionable commercial practices, fraud, deception, or misrepresentation. Violations may entitle consumers to treble damages and attorneys' fees.
- New Jersey Contractor's Registration Act (N.J.S.A. 56:8-136 et seq.) — All home improvement contractors in NJ must be registered with the Division of Consumer Affairs.
- Delaware Consumer Fraud Act (6 Del. C. § 2511 et seq.) — Prohibits deceptive practices in consumer transactions. Consumers retain rights to civil action and statutory damages.
11.2 Nothing in these Terms limits or excludes any liability that cannot be excluded under applicable consumer protection law.
12. Customer Content & Reviews
12.1 Customers may voluntarily submit reviews, testimonials, photos, or before-and-after images of their roofing projects. By submitting such content, you grant ALFE Roofing a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and display the content for marketing and promotional purposes.
12.2 You represent that any content you submit is accurate, does not infringe any third-party rights, and is not defamatory, obscene, or otherwise unlawful.
13. Privacy Policy
Your use of this website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes how we collect, use, and protect your personal information in compliance with applicable PA, NJ, and DE privacy laws.
14. Termination of Service
ALFE Roofing reserves the right to refuse service or terminate any contract, at our discretion, under circumstances including but not limited to:
- Non-payment of amounts owed
- Provision of fraudulent or materially inaccurate information
- Failure to provide safe or accessible working conditions
- Abusive, threatening, or inappropriate behavior directed toward our staff or subcontractors
- Discovery of undisclosed hazardous materials (asbestos, lead paint) requiring specialized abatement
In the event of termination, you remain responsible for payment for all work completed through the date of termination, plus any reasonable demobilization costs.
15. Governing Law & Venue
15.1 These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law principles.
15.2 For any claims not subject to the arbitration provision in Section 10, or for enforcement of an arbitration award, you consent to the exclusive jurisdiction of the state and federal courts located in Philadelphia County, Pennsylvania.
15.3 If you are a consumer in New Jersey or Delaware, applicable mandatory consumer protection laws of your state of residence may also apply, and nothing in this Section limits your ability to bring claims under those laws in your state's courts.
16. Changes to These Terms
ALFE Roofing reserves the right to update or modify these Terms at any time. We will post the revised Terms on this page with an updated "Effective Date." Material changes will be communicated via a notice on our website homepage or by email where feasible. Continued use of our website or services after the effective date of the revised Terms constitutes your acceptance of the changes.
